Campionatul Mondial de Fotbal.

Miliarde de ecrane TV conectate la cortexuri umane. Vizibilitate imensa oricarei marci care se promoveaza in spatiul dedicat jocului de fotbal.
Primele statistici vin de la The Guardian: Compania Nike conduce in topul celor mai mediatizate nume de la Cupa Mondiala din Africa de Sud, americanii devansadu-i pe rivalii de la Adidas la nivelul vizibilitatii de pe internet, (sursa). Pe trei se afla Coca-Cola, in timp ce Sony se gaseste pe patru. Producatorul american de echipamente sportive ofera imbracaminte pentru noua din cele 32 de echipe de la turneul final.
Cristiano Ronaldo, Wayne Rooney, Ronaldinho si Ribery vs. Messi si Zidane (se distinge diferenta, nu?!

Am facut niscai specificatii sumare despre inregistrarea marcii. Cu plusuri si minusuri.
As adauga acum, in virtutea statisticii de mai sus, ca asa se poate monetiza (evalua si “contabiliza”) marca. Aceasta se poate valorifica, in functie de caz, prin:
- licentiere, (licentiere: transferul drepturilor de folosinta a marcii in schimbul unui pret)
- cesionare, (cesiune: transferul tuturor drepturilor asupra marcii)
- fuzionare de firme (atunci cand titularul este persoana juridica; in cazul fuzionarii, drepturile asupra marcii ii revin noii societati)
- gaj (marca, apartinand fondului de comert al unei societati, poate face obiectului gajului comercial);
In mod evident, marcile vizibile (care beneficiaza de branding sustinut) au mega-structuri analitice, care raporteaza schimbarile piatei concurentiala mai mult (sau la fel de mult) cat se investeste in noi tipuri de canale, vehicule si soiuri de comunicari (creative communication).
Tot la OPORTUNITATIILE inregistrarii marcii as specifica: titularul unei marci poate cere in instanta folosirea fara drept a marcii, contrafacerea sau imitarea ei frauduloasa, acest lucru constituind infractiune ce se pedepseste cu amenda sau inchisoare:
- in aceste cazuri titularul poate cere despagubiri substantiale;
- prin emiterea unui consimtamant de folosire a marcii de catre un tert, titularul poate cere acestuia foloase banesti.

Romania supravegheata pentru eficienta masurilor de protejare a drepturilor de proprietate intelectuala.
The Office of the United States Trade Representative (USTR) a dat publicitatii, raportul anual Special 301, care analizeaza eficienta masurilor de protejare a drepturilor de proprietate intelectuala in tarile care au raporturi comerciale cu SUA, Romania fiind inca sub supraveghere.
Combaterea infractiunilor privind drepturile de proprietate intelectuala este o prioritate vitala in Europa, pentru cei circa 18 milioane de americani care lucreaza in industrii bazate pe drepturile de autor.
“Furtul de continuturi protejate de legea proprietatii intelectuale este un factor care ucide afacerile americane bazate pe export si duce la reducerea numarului de locuri de munca pentru americani. Raportul Special 301, realizat de USTR, este important, deoarece el serveste ca fundatie pentru procesul anual de adoptare de reforme care sa sustina comertul si locurile de munca ale americanilor care lucreaza in domeniul drepturilor de autor”, a declarat Ron Kirk, negociator-sef pentru comert in cadrul USTR.
Potrivit raportului, Romania va ramane si in 2010 pe lista de supraveghere, desi se specifica faptul ca in 2009 tara noastra a luat o serie de masuri pozitive in combaterea pirateriei.

Remuneratie similara:
Curtea Constitutionala a Romaniei a declarat drept neconstitutional un articol din legea privind dreptul de autor si drepturile conexe, care prevede o remuneratie mai mica pentru beneficiarii drepturilor conexe fata de cei ai drepturilor de autor, informeaza Uniunea Producatorilor de Fonograme din Romania (UPFR) – organism de gestiune colectiva a drepturilor conexe ale producatorilor de muzica din tara noastra.
CCR a decis ca Articolul 134/alin.2/lit.g din Legea Nr.8/1996 privind dreptul de autor si drepturile conexe, modificata si adaugita, este neconstitutional si l-a anulat prin Decizia 571 din 29.04.2010.
“Art. 134/alin.2/ lit.g nedreptatea doua categorii de beneficiari de drepturi conexe din lumea muzicii romanesti – artistii interpreti si producatorii de fonograme, limitand remuneratia aferenta drepturilor conexe cuvenite acestora la o treime din remuneratia pentru drepturile de autor”, precizeaza UPFR.
Aceste variabile pot veni si in alte sectoare de prestari servicii artistice si culturale: ma gandesc la teatru, literatura tiparita sau te mai miri pe unde?! Inchid acolada pana nu scriu ceva daunator mie… Si-asa scriu si sterg de 10 min… Tu-va interesele in cur, dara!

se schimba ‘armonizarea’ iar la OSIM.
Pentru cei care au marci inregistrate incepe stressul. Aceasta noua lege nu mai prevede examinarea ex-officio a marcilor pentru motive relative de refuz. Cu alte cuvinte, nu vor mai fi emise refuzuri la inregistrare pe baza existentei unor marci anterioare similare sau identice (pe produse similare sau identice).
Acest lucru implica transferul apararii drepturilor de proprietate industriala de la Oficiul Roman la proprietarul de drept al acestora.
Titularii marcilor vor trebui sa urmareasca saptamanal buletinele emise de OSIM, OMPI si OHIM (cele 3 institutii care publica marci ce pot produce efecte pe teritoriul Romaniei) pentru a evita acordarea unor marci similare sau identice cu ale lor.
Ca acest sterss sa fie diminuat sau exclus definitiv, aceasta monitorizare este ideal sa fie facuta de un specialist in domeniu. Raluca Ardeleanu, Consilier in Proprietate Industriala, cu o vasta experienta in OSIM si in alte oficii europene, ne prezinta avantajele acestei actiuni:
- certitudinea ca marca sa nu va fi copiata/imitata si aplicata pe produse/servicii similare/identice, de o calitate indoielnica;
- evitarea unor actiuni in instanta pentru apararea marcii prin anularea marcii similare/identice ulterior acordate (o data acordata marca, aceasta poate fi anulata doar in instanta, cu cheltuielile aferente de bani si timp);
- obtinerea acestor avantaje cu cheltuieli minime, sub forma unui abonament lunar.

Analyse that!

As a long-time CorelDRAW user, and a graphic designer, I was very excited to see the release of CorelDRAW X5. Although I have the full Adobe Creative Suite installed alongside Corel, I often choose CorelDRAW as my primary vector/bitmap application. That said, I was very disappointed after trying out the demo of X5. It looks like only a slight update (like a service pack to X4) – it is not the revamp I was looking for.
I will likely still purchase the upgrade to X5, but it will not change my impression that Corel is becoming less and less important to professional graphics.
CONS (not going into the full list):
- Not made for Windows 7. Floating palettes in the application are not made for Windows Vista or Windows 7 computers. As such they move around on the screen when the app is minimized, and they do not retain their display state. The floating palette titles are also unreadable when they are minimized.
- Same bugs as CorelDRAW X5. Photo-Paint effect previews are still buggy and often break if you turn on and off the preview (for comparing before and after). If you have a complex feathered mask, the preview does not function.
- Most tools are unchanged. One example is the Huge/Sat/Brightness. It is still the same code since version 10 (with the same limitations compared to Photoshop’s Hue/Sat/Lightness).
- Display is still laggy under Windows 7.
- Drop shadow tool is untouched and still an awful tool. You can’t set a setting that will be consistent across objects of all shapes and sizes (ie, same pixel feathering and distance from edges). InDesign has a great drop shadow support. It’s not rocket science.
PROS:
- Color management has been greatly overhauled and it looks to be vastly improved over previous versions.
- File exporting and image saving are improved and require less steps. This should speed up the workflow.
- Some application speed ups are noticed when running on a quad core i7. The multiprocessing support is a good addition (though a version late).

This is newest, (today launch) of the Glasgow 2014 Commonwealth Games logo.
After a worldwide search, the successful brand came from the Glasgow design agency Marque.
The logo has been based on three principles of sport – time, data, and measurement.
There is also a Gaelic version, the first time a Games logo has been produced in a language other than English. The logo, which has cost £95,000 to produce, will be offered exclusively to companies in return for sponsorship. This is the first major launch for the Glasgow Games, revealing the brand which will be identified with it for the next four years.

Glasgow design agency Marque is responsible for the identity design project, said to have cost £95,000 (each logo?). This fee covers such elements as brand guidelines, animated work, visual language, typography, photographic style, and art direction. So, why they change it from autumn 2009 to springtime 2010???

Anyway, we believe this is more inspired source of notorius sport club logo. This is the difference over one hundred years. The difference is birthyear.

Google has just acquired Picnik,
a popular web-based image editing software. The sale was announced on the Picnik blog and the Google Photos blog.

Picnik, which first started in 2005, has become a popular online alternative to image-editing software such as Photoshop. While not as feature-rich as its desktop counterparts, its user experience, simplicity and upbeat design have helped it gain nearly two million monthly U.S. visitors, according to Compete.
BTW: do you know about Adobe Photoshop new logo?

Terms of the deal were not disclosed, but Picnik will remain up and operational, at least for the foreseeable future. It’s very possible that Google could turn Picnik into part of its Google Apps suite, though Google hasn’t announced its plans for the image editing tool.
Google has been on an acquisition spree in recent months. This month alone, Google acquired Aardvar, a social search startup, and purchased reMail, a mobile e-mail utility app.

To respond to the desperate young indifference towards anti-tobacco speech, Rights of Non-Smoking chose today to break with the warmth of preventive campaigns. Young people are insensitive to the health arguments. The first cigarettes were seen as a rite of passage to adulthood, the expression of a form of autonomy and empowerment.
The campaign devised by the agency seeks to reverse this view and to create awareness that smoking is not free themselves from the authority but is instead a sign of submission and naiveté: Quote behavioral, psychological and physically addictive drug that will control their actions, defile their bodies and even cost them dear.
This communication takes advantage of upset young smokers in their indifference through visual impact and nuisance symbolizing the submission. Visuals destined to finally react, create debate and to provide non-smoking reasons to declare themselves proud to remain free and rebellious against the tobacco.
“Smoking is like to be slave to tobacco.”
“The old arguments – tobacco is not good – not working. The message here is that tobacco is a form of submission. In the popular imagination, oral sex is the perfect symbol of obedience,” said Marco de la Fuente, chief project for the agency BDDP et Fils.
